1. Parties
Seller/Provider: FlyGravity, Oludeniz, Denizpark Cd. No: 13, 48300 Fethiye/Mugla.
Buyer/Consumer: The person who creates a booking through the website and shares their full name, email, phone, service, date/time, and guest count in the booking form.
This agreement is formed upon the Buyer's electronic approval.
2. Subject of the Agreement
The subject of this agreement is the determination of booking, payment, performance, cancellation, and refund conditions for the paragliding, boat tour, safari, diving, culture route, private tour, or transfer service selected by the Buyer on the FlyGravity website.
3. Service, Price, and Payment
- The basic features, date/time, guest count, total price, deposit, and payment method of the service are shown on the booking screen.
- Services included in the price are stated in the package description. Personal expenses, additional transfers, photos/video, or third-party costs not included may be stated separately.
- Payment can be made by IBAN/bank transfer, iyzico, or other payment methods activated on the site.
- Card data is not stored by FlyGravity; if payment is made by card, the transaction is processed through the secure infrastructure of the payment provider.
4. Pre-information and Approval
The Buyer acknowledges that before placing an order/booking, they have been informed about the basic features of the service, price, payment method, delivery/performance conditions, cancellation/refund terms, withdrawal right exceptions, contact information, and dispute resolution bodies.
The Buyer declares that they have read and accepted the Distance Sales Agreement, Delivery and Refund Terms, Privacy & Data Protection Notice, and Cookie Policy before completing the booking.
5. Performance of Service
- The service is performed on the date/time selected in the booking or confirmed by the FlyGravity team.
- For paragliding and outdoor activities, performance is subject to weather conditions, safety, pilot/team availability, and official/operational restrictions.
- If safe performance is not possible, FlyGravity may postpone the service, suggest an alternative date/time, or initiate a refund process.
6. Right of Withdrawal
As a rule, the consumer has the right of withdrawal within 14 days in distance contracts. However, leisure services for entertainment or rest to be carried out on a specific date or period, and services whose performance has begun with the consumer's consent, are among the withdrawal right exceptions.
Services purchased through FlyGravity are generally leisure/tourism services for which capacity is reserved for a specific date and time. Therefore, the withdrawal right exception may apply. The cancellation/refund terms offered by FlyGravity are regulated on the Delivery and Refund Terms page.
7. Cancellation, Refund, and No-Show
- Cancellations made more than 24 hours in advance may be eligible for a payment/deposit refund.
- For cancellations made less than 24 hours in advance or if the Buyer is not present at the appointment time, a refund may not be made.
- For services cancelled by FlyGravity due to weather or safety reasons, an alternative date/time is offered; if no suitable alternative is found, a refund may be made.
- Refund requests must be submitted to gravitytandemparagliding@gmail.com with the booking code.
8. Responsibilities
- The Buyer is obliged to provide accurate and up-to-date information in the booking form.
- The Buyer is obliged to comply with safety instructions given by the operations team.
- FlyGravity takes reasonable care to ensure the service is carried out safely and in compliance with applicable law; FlyGravity cannot be held responsible for delays/cancellations arising from force majeure, weather conditions, and official restrictions.
9. Dispute Resolution
Turkish law applies to disputes arising from this agreement. For consumer transactions, within monetary limits, Consumer Arbitration Committees and Consumer Courts at the Buyer's place of residence or where the transaction was made are competent.
10. Entry into Force
This agreement is deemed accepted electronically when the Buyer creates a booking through the website, completes the payment step, or checks the relevant acceptance boxes.
